Inspectors reported 36 items found out of compliance during recent routine inspections of local food establishments.
The classification of being in or out of compliance replaces previous health department terminology of critical and non-critical violations. Compliance is based on the number of risk factor or intervention violations, and whether there are repeated issues.
The violations include unsanitary employee practices, dirty equipment, equipment requiring repair, the potential for sewage mixing with fresh water, and improper food temperatures. Some items may be corrected on site during the inspection, indicated by “COS.”
Establishments are required to post the most recent routine inspection form adjacent to the front public entrance for potential customers to view.
Wayne County Health Department employees collected these concerns between April 8-May 2.

April 23: Ron DeVoo, 99 N. Perry St., Hagerstown: North and east doors have a gap greater than ¼” at bottom. No ETA for correction.
April 22: Kroger #914, 3701 National Road E., Richmond: Three containers of Nutramigen Hypoallergenic Infant Formula store at “Last Chance” station marked “Use by 1 Mar 25.” COS. Twelve fan guards in the meat department’s walk-in cooler are soiled and in need of cleaning. To be corrected by May 7. Floor drains within the deli’s chicken preparation area are heavily soiled with food debris. COS.
April 22: Penn Station, 1500 E. Main St., Richmond: The following food items were found chilling at temperatures higher than the required 41 degrees Fahrenheit or below: Provolone cheese cold-held in reach-in cooler at 57 degrees. COS; Stored turkey cold-held in reach-in cooler at 44 degrees. COS; Raw chicken held in reach-in cooler at 43 degrees. COS; Ham held in reach-in cooler at 45 degrees. COS; Sliced pepperoni held in reach-in cooler at 52.9 degrees. COS. Raw chicken and raw beef observed thawing at a prep sink area. COS. Hose lying in the middle compartment of a 3-bay sink was attached to sink’s faucet. To be corrected by May 5. Sink is not protected from back siphonage. COS. April 21: Roasted, 5585 Park Elwood Road, Richmond. Employees handling exposed food observed without beard restraints. COS.
April 16: Leland Legacy, 900 S. A St., Richmond. Employees handling exposed food not wearing beard restraints. COS.
April 14: Naomi’s, 15557 Goose Heaven Road, Cambridge City. Countertop has open seam and is not sealed to an easily cleanable area; countertop not sealed to wall. Both items to be corrected by April 24. Follow-up: On April 25, it hadn’t been repaired. A new deadline was set for May 5.
April 11: Middlefork Reservoir Concessions, 1750 Sylvan Nook Drive, Richmond. Counters and backsplash need to be re-sealed. To be corrected by May 11.
April 11: Wayne County Correctional Center, 200 E. Main St., Richmond. Walk-in freezer floor soiled with debris. To be corrected by April 18. Mops stored in mop water rather than being hung to dry. COS.
April 9: Willie and Red’s, 40 E. Main St., Hagerstown. Cold buffet items measured greater temperatures than the required 41 degrees Fahrenheit or below: Cole slaw at 46.1 degrees; ham salad at 46.5 degrees; sliced tomatoes at 49.9 degrees; pasta salad at 50.2 degrees; pea salad at 50.2 degrees; potato salad at 46.4 degrees. April 8: Arby’s East: 320 National Road E., Richmond. There is a direct connection between the sewer system and the drain to the 3-bay sink. To be corrected by April 28. The interior of the reach-in prep cooler is soiled with food debris. COS. The hot-hold unit above the food prep cooler is soiled. COS. Food pan lids at the sandwich prep area are soiled. COS. Inspections
Wayne County Health Department inspects local stores, restaurants, schools and other food providers at least twice per year. If any critical violations are found, inspectors follow up to ensure the establishment has made the necessary corrections. They also make visits if members of the public submit complaints.
