Two Richmond businesses are suing the City of Richmond and another local business for damages they say are caused by preventable sewer system overflows.
Pizza Equipment Co., doing business as Asset Logistics Inc., and Sanjo Management, both at 1050 Progress Drive, filed a civil case July 29 in Wayne Circuit Court, describing negligent acts and/or omissions related to sewer issues.
They’re seeking damages from Richmond Beverage Solutions, 1590 NW 11th St., and the city.
Asset Logistics and Sanjo allege that the defendants negligently dumped and allowed the dumping of dairy byproduct into the sewer system that led to an overflow of sewer water after a hard rainstorm around March 4.
In the complaint, the plaintiffs say water and sewage backed up into their commercial property and caused significant damage to the building, business personal property losses, mitigation and repair costs, and labor and time-related losses for employee wages and parts inventory. They say the city officials should have known about RBS’ dumping or silently acquiesced to its actions.
Asset Logistics and Sanjo seek compensatory damages for economic and noneconomic damages, punitive damages, and attorney fees and costs. They’re represented by Phillip Wiehe of Law Offices of Blake R. Maislin, LLC, in Moraine, Ohio.
Court records showed no responses from the defendants as of press time.
